In these Terms, “Balearicon”, “we”, “us” and “our” mean ETHICALYZE LLC. “You” means the person using our website, purchasing our services or making a booking through us.

These Terms govern our website, passes, memberships, other directly supplied services and intermediary services. Mandatory consumer rights remain unaffected.

2. Our Services and Your Contracting Party

Services supplied by Balearicon

We sell Balearicon passes, memberships and other expressly identified services on our own account. For these purchases, your contract is with ETHICALYZE LLC, and we are responsible for supplying the agreed services.

Services supplied by independent Providers

We also provide information about and facilitate bookings or contact with independent tour operators, event organisers, transport companies and other service providers (“Providers”).

For an offer identified as a third-party service, your contract for performance is with the Provider identified before booking. We are responsible for the intermediary obligations we undertake; the Provider is responsible for performing its service.

A listing or recommendation does not, by itself, mean that Balearicon organises the event or supplies the listed service.

The relevant offer and booking process will identify the supplier and explain our role. Nothing in these Terms overrides responsibilities imposed by applicable law, including mandatory package travel protections where applicable.

3. Eligibility and Customer Information

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase services or make bookings.

You must provide accurate contact, payment and booking information. If you act for another person, you must have the necessary authority and communicate relevant conditions to that person.

Participation by minors in third-party activities is subject to the Provider’s requirements.

4. Balearicon Passes and Memberships

Balearicon passes and memberships are services providing access to digital platform features together with the support and member benefits described in the selected offer.

The 7-Day Tourist Pass includes discovery access, live updates and alerts, member prices and concierge support via WhatsApp, as described in the offer at purchase.

The product description forms part of your contract. It specifies the included features, price, duration, access method and any essential technical or usage requirements.

Unless expressly included, the purchase price does not cover event admission, tours, transport, accommodation, meals or other third-party services. These require separate bookings and payment.

Member prices and offers remain subject to their disclosed conditions and availability. Concierge support does not guarantee a reservation, admission or a particular outcome. Any promised support hours or response times will be stated in the offer.

5. Activation and Validity

The 7-Day Tourist Pass activates automatically when your purchase is completed and payment is successfully confirmed. It remains valid for 168 consecutive hours from that activation time.

The validity period begins immediately upon successful payment, regardless of when you first log in, access the content, request assistance or arrive in Mallorca.

A pending, failed or merely initiated payment does not activate the pass.

Your purchase confirmation will identify the activation and expiry times, including the applicable time zone. The pass expires automatically at the end of its validity period.

Non-use does not pause, extend or restart the validity period. This does not affect withdrawal rights or remedies for a failure to supply the agreed service.

Other passes and memberships also begin upon successful purchase and payment, unless their offer expressly provides for a different start date. Their duration is stated before purchase.

The 7-Day Tourist Pass is a one-time purchase and does not renew automatically. Any recurring membership requires your express agreement to the price, billing frequency, renewal and cancellation conditions disclosed before purchase.

6. Orders and Contract Formation

Before paying, review the selected service, total price, duration and applicable conditions. By submitting a paid order, you agree to pay the disclosed total.

For an immediately activated Balearicon pass, the contract is concluded when payment is successfully confirmed and the purchased service is activated. We will send electronic confirmation using the contact details you provide.

For other services supplied directly by us, any different acceptance procedure will be explained before ordering.

For third-party bookings, contract formation follows the process disclosed for the relevant Provider. An enquiry or acknowledgement of receipt is not a confirmed booking unless expressly stated.

Contact balearicon@ethicalyze.com promptly if your confirmation is missing or contains an error.

7. Prices and Payments

The total payable price, currency, applicable taxes and mandatory fees are disclosed before you commit to purchase. Optional extras require your agreement.

Available payment methods are shown during checkout. Payments may be processed by an external payment processor.

We receive payment for our own services on our own account. If we collect payment on a Provider’s behalf, that role will be disclosed.

Changes to advertised prices do not retrospectively change the agreed price of an existing purchase.

8. Access and Permitted Use

You must have a compatible device, an internet connection and access to any communication channel identified as necessary before purchase.

Unless the offer permits wider use, pass access is for your personal, non-commercial use. You may save information for personal travel planning, but must not resell access, publicly distribute access credentials or commercially reproduce protected content without permission.

Contact us promptly if paid access is unavailable or does not work as described. We will investigate and provide an appropriate remedy where required.

Activation, access credentials or first use alone do not constitute full performance of a service that we must provide throughout an agreed period.

9. Event Information and Third-Party Offers

We take reasonable care in preparing and presenting information and remain responsible for meeting our contractual promises and applicable legal standards.

Events, opening times, prices, availability and programmes may change. An informational listing is not a reservation or a guarantee that an event will take place.

Check essential details with the organiser before travelling or purchasing separate tickets.

Where live updates or alerts form part of your purchase, we will supply them as described. Such features do not imply continuous monitoring of every event or an immediate notification of every change unless expressly promised.

A third-party event change does not automatically entitle you to a refund of a properly supplied Balearicon pass. Your remedies remain available if our own service fails to meet the agreed description or applicable legal requirements.

10. Third-Party Booking Conditions

Review the Provider’s service description, participation requirements and cancellation conditions before booking.

Provider conditions forming part of your contract must be available before you commit to purchase. They may address amendments, late arrival, non-attendance, safety requirements and refunds.

There is no universal Balearicon free-cancellation period for third-party bookings.

Send cancellation or amendment requests through the method specified in your booking confirmation. A requested amendment is effective only once accepted by the relevant contracting party.

If a Provider cancels or materially changes a service, your remedies depend on the contract and applicable law. You do not have to accept a voucher where you are legally entitled to a monetary refund.

We will provide reasonable assistance concerning bookings we handle, within the scope of our responsibilities.

11. Cancellation of Balearicon Services

Any additional voluntary cancellation or refund option will be stated in the relevant offer.

Outside applicable withdrawal rights, disclosed cancellation options and remedies for a failure to perform, a change of plans or non-use does not itself create a refund entitlement.

Expiry of a pass does not remove claims arising from non-delivery, unavailable promised access or another breach of our obligations.

12. Consumer Right of Withdrawal

Where EU or EEA consumer withdrawal rules apply, you generally have 14 days from conclusion of the contract to withdraw without giving a reason, subject to applicable legal exceptions.

To withdraw, notify ETHICALYZE LLC by an unequivocal statement sent to balearicon@ethicalyze.com or our postal address in Section 1. Sending your notice before the withdrawal period expires is sufficient.

You may use the model form below, but it is not mandatory.

Immediate commencement

Balearicon passes are intended to begin immediately after successful payment. Where required by law, we will obtain your separate express request to start providing the service during the withdrawal period.

If you withdraw after expressly requesting early performance, you may be required to pay a proportionate amount for services supplied up to the time you notify us, but only where the applicable legal requirements have been met.

The calculation will reflect the agreed service and the extent of performance. Where applicable, a separately identifiable service already fully supplied may be considered as permitted by law.

Your withdrawal right is lost upon full performance only if performance began with your prior express consent and acknowledgement that you would lose that right once the contract had been fully performed.

Payment, activation or first use alone does not remove the withdrawal right. Acceptance of these Terms alone does not replace the required separate request, consent or acknowledgement.

The statutory exception for certain leisure services scheduled for a specific date or period does not automatically apply to a Balearicon pass. Separate third-party bookings may be subject to that exception where its legal conditions are satisfied.

Refunds following withdrawal

Where reimbursement is due, we will refund the amount payable without undue delay and within 14 days after receiving your withdrawal notice, using the original payment method unless you expressly agree otherwise. We will not charge a refund fee.

More protective mandatory rights remain unaffected.

13. Participation and Safety

For third-party activities, review the disclosed age, accessibility, health, equipment and other participation requirements.

Follow lawful and reasonable safety instructions. Contact the Provider before booking if essential suitability information is missing.

These Terms do not waive personal injury claims or other rights that cannot lawfully be waived.

14. Our Responsibility

We are responsible for our own services, representations and intermediary obligations.

Mandatory rights concerning supply, conformity, correction, price reduction and termination remain unaffected.

We are not automatically responsible for a Provider’s performance solely because we list or facilitate its service. This does not exclude liability arising from our own acts, omissions or legal duties.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.

Circumstances outside our reasonable control do not automatically remove refund rights or permit retention of payment for an unperformed obligation.

15. Website Use and Intellectual Property

You must not submit fraudulent orders, interfere with website security, introduce harmful software or misuse another person’s information.

Website materials belong to ETHICALYZE LLC or the relevant rights holders. A purchase grants the agreed access and usage rights and does not transfer intellectual property ownership.

External websites have their own terms and privacy practices.

16. Privacy and Communications

Our separate Privacy Policy explains how we process personal information, including information used to provide access, deliver support and facilitate bookings.

Relevant information may be shared with Providers where necessary and as explained in that policy.

Acceptance of these Terms does not constitute consent to optional marketing.

We may contact you about your purchase, access, booking or relevant service changes using the details you provide.

17. Complaints

Send questions or complaints to balearicon@ethicalyze.com, including your order or booking reference and a description of the issue.

For problems during a third-party activity, notify the Provider promptly so that it has a reasonable opportunity to assist. You may also contact us for support.

This does not shorten statutory limitation periods or make contacting us a condition for exercising legal rights.

18. Applicable Law, Updates and General Provisions

Applicable law and jurisdiction are determined by the relevant legal rules. These Terms do not impose exclusive Wyoming jurisdiction on consumers or deprive them of mandatory protections or access to courts available under applicable law.

Updates to these Terms apply to future transactions. They do not retrospectively amend existing contracts unless a valid agreement or applicable law permits the change.

Changes to ongoing services remain subject to the contract and applicable statutory requirements.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

These Terms are provided in English. Mandatory language and information requirements remain unaffected.
